Policy Statement and Reason
For the purpose of this policy, employees include Massachusetts and California faculty and staff. All provisions of this policy apply, except that for employees covered by a collective bargaining agreement, this policy does not create any benefits not expressly provided by that collective bargaining agreement and if there are inconsistencies between this policy and the collective bargaining agreement, the terms of the collective bargaining agreement will govern.
Emerson College reserves its right as an at-will employer to end an individual’s employment at any time, with or without cause, and with or without notice.
Policy Guidelines
Eligibility
This policy applies to all employees, except as stipulated by an applicable collective bargaining agreement.
At-Will Employment
Employment at Emerson College is “at will.” This means that employees are free to resign at any time. Similarly, Emerson College may terminate the employment relationship at any time, with or without cause or prior notice, as it deems appropriate. Nothing in this policy or any other policy of Emerson College shall be interpreted to be in conflict with or to eliminate or modify in any way, the at-will employment status of Emerson College employees.
Other Actions Affecting Employment
Emerson College also retains discretion to take other actions affecting employment, such as transfer, reassignment or disciplinary action. In addition, because the employment relationship is at-will, Emerson College may change its employment policies from time to time in its discretion. The at-will employment status of an individual employee of Emerson College may be modified only by a written employment agreement with that employee or a collective bargaining agreement covering that employee’s position which is signed by the President of Emerson College.
