Talent Release Form
This is a release of legal rights; please read and understand before signing.
In consideration for the opportunity to have my work distributed, I authorize Emerson College and/or those it designates (“Emerson”) to record my name, likeness, image, voice, and performance on film, video, audio, digital files, or any other format (“Recordings”) for use, in whole or in part, in perpetuity worldwide by Emerson for educational, scholarly, promotional, or other purposes, in any format or media now known or later created. I authorize the use of my name, likeness, image, voice, and biographical material (“Personal Information”) in connection with the Recordings.
I grant and assign to Emerson all right, title, and interest in and to the Recordings, including, without limitation, copyright. I confirm that: (1) I have the right to enter into this agreement; (2) my performance in the Recordings and the rights granted in this agreement will not conflict with or violate any commitment I have with any other person or entity; (3) I own or have legal permission to use any artistic content or work that is part of the Recordings, including, but not limited to, music and video content; and (4) Emerson has no financial obligation to me for the Recordings, the use of any Personal Information, or this agreement. If I am a student, I understand that the Recordings or Personal Information may constitute educational records protected by the Family Educational Rights and Privacy Act (FERPA). I hereby waive my rights under FERPA with respect to Recordings and Personal Information, and consent to Emerson sharing them as outlined in this Release.
I release, discharge, and agree to hold harmless Emerson, and all persons or entities acting under its permission or authority, from any liability (including, without limitation, negligence) for any injury that may occur to me while performing or appearing in the Recordings. I also hereby release and discharge Emerson and its agents, assigns, licensees, and sublicensees from any and all liability to me or to my successors, heirs, or assigns for any claims, including, without limitation, claims for libel, defamation, copyright infringement, invasion of privacy, or right of publicity, arising out of the exercise of rights granted under this agreement.
This agreement represents my entire understanding with Emerson. I have read this Agreement prior to signing it, and I understand its contents. This agreement may not be amended unless Emerson and I agree in writing. This agreement will be governed by and construed under the laws of Massachusetts (excluding its conflicts of laws principles).
In the case of a minor, I hereby warrant that I am the legal guardian of the minor named below and have every right to contract for them in the above regard.
I am signing this digitally and my signature is being transmitted electronically. I agree it has the same effect as though it were provided in original ink form and I will not contest this document or the permission I am granting on that basis.
